What are Arbitration and Mediation?
Arbitration is not litigation. Instead, both parties present their cases to an agreed-upon third party arbitrator (or, in some cases, more than one arbitrator) who reviews all the evidence and renders a decision. The decision of the arbitrator is generally legally binding, with limited recourse to litigation after an unfavorable decision. This makes it important for parties to hire knowledgeable legal counsel because of limited court review.
Mediations are sometimes contractually required, or the parties may agree jointly to try to resolve their disputes through mediation. Mediation allows both parties to be a part of a negotiation to try to resolve their dispute. If the parties are unable to reach an agreement through mediation, they may move to arbitration, or take the matter to court. The option to mediate is available to parties in the middle of litigation or may occur prior to litigation.
